Terms and Conditions Once Upon a Boat

  1. General

www.onceuponaboat.es / www.onceuponaboat.com is operated by Marlot Media, registered with Chamber of Commerce in the Netherlands, KvK number 78667046.

These general terms and conditions apply to all services that are made available online, by e-mail, WhatsApp, social media or by telephone. Marlot Media has the right to change the general terms and conditions.

By making a reservation with me, you acknowledge, understand and agree to the terms and conditions below.

Marlot Media acts as an intermediary through this website and provides communication and marketing services to entrepreneurs and companies, as well as for the boats presented on this site. I hope you are satisfied with me. Are you not? I would like to hear this to find a suitable solution together.

2. Service

Via Once Upon a Boat I offer an online platform under the name Marlot Media, Chamber of Commerce in the Netherlands number 78667046, on which boat owners and skippers can place and offer their services (boat trips on Ibiza and Mallorca), and where you as a booker can reserve the boat trips. If you make a reservation through me, you will enter into an agreement with the relevant service provider (boat owner and / or executive skipper) from whom you rent the boat.

The boat owner and / or skipper delivers a rental agreement on the day of the boat trip, which must be signed by you. I only act as an intermediary between you and the boat tour provider. No agreement is concluded between Marlot Media with regard to the boat rental. The skipper of the boat is responsible for presenting the contract on the day of the boat trip, not Marlot Media.

When booking through Once Upon a Boat you are bound by the booking confirmation and the general terms and conditions as described here.

  1. Payment and delivery

After you have received a confirmation email, the boat in question will be reserved for you. Any deposit will be paid directly to the skipper or boat owner and not to Marlot Media. The remaining payment is due on the day of the boat trip, before the trip takes place. I have the right to cancel the reservation on behalf of the skipper or boat owner, without giving any reason. A delivery of a service takes place as long as there is availability.

  1. Liability of Marlot Media

If Marlot Media is forced to cancel the booking, I will do my best to offer an equivalent alternative. Marlot Media is not liable for any damage in connection with this.

As a mediator, Marlot Media does not accept any liability for damage or personal injury occurring in or around the boat or in or around the motor boat. The skipper or boat owner is, as the other party to the rental agreement, solely responsible for this. If you want to hold the skipper or boat owner liable, I will provide the contact details for this.

The rented boats are strictly for holiday purposes. Professional photography, boat parties or other events on the boat are only allowed with the permission of the skipper or boat owner. Please contact me for this.

  1. Cancellation

Any cancellation must be notified as soon as possible. In case of no-show, no refund of the deposit will be made.

  1. Rates

I reserve the right to change rates on the site at any time without prior notice. You cannot derive any rights from the rates of the boat trips as they are on the site or were stated in the past.

  1. Customer information

When making a reservation, the customer data is included in the Once Upon a Boat database. These will not be provided to third parties.

  1. Complaints

It is important to me that you have a pleasant day on the water and that the boat trip meets your expectations. If something is not right with the boat or with the reservation, please contact me as soon as possible. I will endeavor to mediate and resolve the complaint to everyone’s satisfaction.

Marlot Media acts as an intermediary through this website and provides communication and marketing services to boat owners and skippers. If you want to hold the skipper or boat owner liable, I will provide the contact details.

  1. Force majeure

Marlot media is not liable if a reservation cannot be fulfilled due to force majeure. Force majeure includes a strange cause or circumstance, problems with the skipper and / or boat owner, technical problems with the reserved boat or tender, obstructive weather conditions or weather forecasts, negligence of the skipper or boat owner, illness of the skipper or boat owner.

Marlot media has the right to change or dissolve the obligation in case of force majeure. In this case, Marlot Media cannot be held liable and is reserved to pay compensation.
